These Terms of Service (“Terms”) govern access to and use of the Click Global Talent Talent Management Platform (the “Platform” or “TMP”) operated by Click Global Talent (“Click”, “we”, “us”), in connection with talent sourcing for Australian businesses and employment services provided through Core Support Hub (“Core”) as Employer of Record (EoR) for talent in the Philippines. By registering or using the Platform, you agree to these Terms and our Data Privacy Policy.
1. The service
The Platform is a web-based SaaS environment that supports user registration, resume and profile management, role-based access, recruitment pipelines, client onboarding (including optional agreement workflows), controlled visibility of candidate information, notifications, and integration with payment services (including EonX) for invoicing, transfers, and payroll. Features may be rolled out in phases; not all modules may be available at once.
2. Eligibility and roles
- Talent / applicants: Individuals seeking or engaged in remote opportunities sourced through Click and employed or administered through Core where applicable.
- Clients: Australian businesses approved to use the Platform to view shortlisted, redacted talent profiles and manage their engagement subject to staff workflows.
- Staff: Authorised Click and Core users managing screening, pipelines, redaction, and configuration.
- Super Admins: Senior staff with full configuration and oversight as defined in platform rules.
You must register with accurate information. No guest access is permitted beyond public marketing pages.
3. Account security
You are responsible for safeguarding your credentials. After repeated failed logins, accounts may be temporarily locked. Notify us promptly of unauthorised use.
4. Talent and applicants
- You warrant that information and resumes you submit are truthful and yours to share.
- You consent to Click and Core processing your data as described in the Privacy Policy, including presenting redacted profiles and documents to clients when staff place you in a pipeline stage that permits client viewing.
- You will not use the Platform to circumvent Click or Core or to solicit clients outside approved channels.
- Status tags (e.g. Open for Opportunities, In Pipeline) are set by staff; you may view your status where the UI allows but may not override staff decisions.
5. Clients
- You agree to provide accurate business details (including ABN or applicable identifier) and complete any required payment setup via EonX before certain features (e.g. talent screening) are activated.
- Client accounts may require admin approval. A configurable requirement for a signed service agreement (e.g. via e-signature) may apply before approval.
- You may only view candidate profiles explicitly shared with you. You must not attempt to identify or contact talent outside the Platform or approved processes.
- You consent to Click and Core conducting screening and verification on your behalf as stated at onboarding.
6. Payments
Invoicing, client payments, Click-to-Core transfers, and talent payroll are processed through EonX (and optional accounting integrations). You authorise charges and transfers in accordance with agreed schedules and fee structures. Click is not liable for delays or failures solely attributable to banks, card networks, or EonX, but will work in good faith to resolve operational issues.
7. Acceptable use
- No unlawful, harassing, or deceptive activity.
- No probing, scraping, or reverse engineering of the Platform except as permitted by law.
- No uploading malware or content that infringes third-party rights.
- No direct messaging channel between clients and talent is provided by design; do not use notifications or metadata to bypass this.
8. Intellectual property and content
You retain rights to content you upload (e.g. resumes). You grant Click and Core a licence to host, process, display (including redacted rendering to clients), and back up such content for operating the service. The Platform’s software, branding, and documentation remain our property.
9. Confidentiality
Users must protect non-public information learned through the Platform (including unpublished candidate or client details). Staff are subject to additional confidentiality obligations.
10. Disclaimers
The Platform is provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee uninterrupted availability or that a particular placement will occur. Hiring outcomes depend on clients, candidates, and market factors.
11. Limitation of liability
To the maximum extent permitted by applicable law, Click’s aggregate liability arising from these Terms or the Platform (excluding liability that cannot be limited by law, such as certain consumer guarantees) is limited to the fees paid by the claiming party to Click for the Platform in the twelve (12) months before the claim. We are not liable for indirect or consequential loss.
12. Suspension and termination
We may suspend or terminate access for breach of Terms, risk to security, or legal requirement. You may cease use at any time; provisions that by nature survive (e.g. payment obligations, confidentiality, liability limits) will survive.
13. Governing law
These Terms are governed by the laws of Victoria, Australia, subject to mandatory rules of your jurisdiction where they cannot be waived. Employment relationships between talent and Core are governed by applicable Philippines employment law as reflected in separate employment documentation.
14. Changes
We may modify these Terms. We will provide notice as appropriate (e.g. in-app or email). Continued use after the effective date may constitute acceptance where permitted by law.
